Juvenile Death Penalty

Show Description: According to the Death Penalty Information Center, the state of Texas currently has 29 juveniles on death row. The United States is one of a very few countries, including Iran, Pakistan, Saudi Arabia, and China, which had allowed the death penalty for murderers that were under 18 when they committed their crimes. As of March 1st, the U.S. Supreme Court ruled that juveniles could not be put to death. The ruling implies that maturity and mental capacity help determine the legal level of responsibility. The logic holds that individuals under 18 years of age do not possess the maturity and judgment of an adult. As such, the death penalty should not apply. The Court?s decision makes all the sense in the world. The decision also begs the question as why the death penalty should be constitutional to begin with.
