Let The Old Murderer Go

An old, mentally handicap man is being sent back to jail after 18 years later it was realized that a mental hospital let him out with out informing the judicial system. The problem? He killed someone. I know few will agree, but frankly, I say let him go. You can't convince me that it is ok to send a mentally handicap man to jail after he has been free - and not hiding - for the past 18 years and caused no problems.
